分裂概念和言论自由

本通知旨在遵守田纳西州高等教育言论自由和透明度法案(“法案”),并反映评议委员会和机构对言论自由和学术自由的承诺.

I.     Definitions

A. Divisive Concept means a concept that:
  1. 一个(1)种族或性别天生优于或劣于另一个种族或性别;
  2. An individual, 由于个人的种族或性别, is inherently privileged, racist, sexist, or oppressive, whether consciously or subconsciously;
  3. 个人应因种族或性别而受到歧视或不利待遇;

  5. An individual, 由于个人的种族或性别, 对同种族或性别的其他成员过去所犯的行为负责;

  10. Promotes division between, or resentment of, a race, sex, religion, creed, nonviolent political affiliation, social class, or class of people;
  11. Ascribes character traits, values, moral or ethical codes, privileges, or beliefs to a race or sex, 或者因为一个人的种族或性别而歧视他;
  12. The rule of law does not exist, 而是种族或其他群体之间的一系列权力关系和斗争;

B. Faculty means any person, 这个人是否得到了机构的补偿, and regardless of political affiliation, who is tasked with providing scholarship, academic research, or teaching. “教师”包括终身教授和非终身教授, adjunct professors, visiting professors, lecturers, graduate student instructors, and those in comparable positions, however titled. “教员”不包括主要负责行政或管理的人员.

C. Race or sex scapegoating means assigning fault, blame, or bias to a race or sex, or to members of a race or sex, because of their race or sex, and includes any claim that, consciously or subconsciously, and by virtue of a person's race or sex, 一个种族的成员天生就是种族主义者或有压迫他人的倾向, 或者一个性别的成员天生就是性别歧视者或倾向于压迫他人.

D. Race or sex stereotyping means ascribing character traits, values, moral and ethical codes, privileges, status, or beliefs to a race or sex, 或者因为一个人的种族或性别而歧视他.

II.     言论自由、表达自由和学术自由

  1. 本通知或法案中的任何内容不得解释为:
  2. 侵犯受美国宪法第一修正案保护的言论自由, the Tennessee Constitution, 或田纳西校园言论自由保护法案, as explained in Freedom of Speech and Expression : 1.03.02.60 | policies.tbr.edu;
  3. 侵犯教师和其他教师受美国宪法第一修正案保护的学术自由权利, the Tennessee Constitution, 或田纳西校园言论自由保护法案, as explained in Freedom of Speech and Expression : 1.03.02.60 | policies.tbr.edu;
  4. Require an employee to:
    a. Violate any federal or state law, rule, or regulation; or
    b. 未能遵守任何适用的学术评审规定;
  5. Prohibit an institution from training students or employees on the non-discrimination requirements of federal or state law; or
  6. 禁止一个机构促进多样性, equity, and inclusion, 只要这些努力符合国家法律.
III.     Prohibited Activity

机构和员工不得处罚, discriminate against, 或因学生或雇员拒绝支持而从事任何不利待遇, believe, endorse, embrace, confess, act upon, 或者同意一个或多个分裂的概念.
任何机构或任何雇员都不得要求学生或雇员支持特定的意识形态或政治观点才有资格被雇用, tenure, promotion, or graduation.
学校及其工作人员不得在威尼斯人娱乐城时询问申请人的思想政治观点, student, job applicant, job candidate, or candidate for promotion or tenure. 本条不应被解释为禁止课堂教学或讨论, 禁止任何其他教学或教学活动, to interfere with academic freedom, 或违反校园言论自由保护法, as explained in Freedom of Speech and Expression : 1.03.02.60 | policies.tbr.edu.
